ACCEPTANCE OF TERMS AND CONDITIONS
By using Liberty Carz, you agree to be bound by all terms and conditions contained in the Liberty Carz Term & Condition. If you do not agree with our terms and conditions at any time, you will discontinue your use of Liberty Carz . Liberty Carz reserves the right to update or revise our Term & Condition at its discretion and without notice. You are responsible for checking the Term & Condition periodically for changes. You can review the most current version at any time here. If you continue to use Liberty Carz following the posting of any changes, you agree to be bound by these changes. In addition, when using particular Liberty Carz services, you and Liberty Carz shall be subject to any posted guidelines or rules applicable to such services, which may be posted from time to time. All such guidelines or rules are hereby incorporated by Liberty Carz deem inappropriate. Liberty Carz reserves the right, but assumes no obligation, to delete, move, or edit any listings or postings on our app. You understand and agree that the Services are provided “AS-IS” and “WHERE-IS ”.
DESCRIPTION OF SERVICE
Liberty Carz is a digital automotive marketplace that brings together consumers, automobile dealers, and other automotive service and automotive industry professionals, who are potentially willing to buy or sell cars.
As a registered and activated member, you will have the privilege to view cars Liberty Carz app. As a registered and activated member you can decide how much you are willing to offer for that car.
You understand that Liberty Carz does not control the price and any other terms of all sales offered through on app and that these might be within the control of the seller and/or dealer of that car or automotive-related services.
BUYERS
By searching the automotive and services listings that have been posted on the Liberty Carz app, you are designating yourself as a “Buyer”. Buyers are entities that are potentially interested in purchasing one of the automobiles or services that have been posted on the Liberty Carz app. The app provides a venue whereby Buyers can buy automobiles, cars and related automotive services that may be of interest to them, and the information that is available for that. Buyer to book on a car and/or purchase a related service(s). By using Liberty Carz’s services, accessing its app and
booking, purchasing cars, you are acknowledging that you have fulfilled all legal requirements necessary to conduct trading in cars, both new or used, as required by the respective authorities.
MEMBERSHIP & REGISTRATION OBLIGATIONS
To obtain access to many of the features of our app, you will be given the opportunity to register with Liberty Carz. Liberty Carz requires registration if you wish to use any of the features of the app. In consideration of your use of the service (“Service”) you agree to:
- a) provide true, accurate, current and complete information
about yourself as prompted by the registration form (such information being the “Registration Data”).
- b) maintain and promptly update the Registration Data to ensure that it is at all times true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or Liberty Carz has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or in case of fraud or approaching our customers and/or sellers and/or buyers, or in case of monetary or reputation loss, Liberty Carz has the right to suspend or
terminate your account and refuse any and all current or future use of the Service (or any portion thereof).
Registered members have access to such features as detailed information related to inventories, and can participate in purchasing cars. You understand that not all cars posted on Liberty Carz are for sale, as they might be subject to the owner agreeing to your price offer. You additionally understand that there are particular features and/or services provided through Liberty Carz that may have their own purchase policies and/or terms of services; by using these features/services you agree to be bound by their respective terms. Membership at Liberty Carz is only open to individuals 18 years of age and older. Nevertheless, Liberty Carz reserves the right to deny membership privileges to any individual, in its sole and absolute discretion. Buyers must complete the registration form. Liberty Carz accepts deposit payments via bank transfer, cash or credit card (Visa and MasterCard will be accepted for payment).
BUYER ACCOUNT
You will receive an account designation, along with its associated Phone and Password, upon completing the registration process. You are responsible for maintaining the confidentiality of your Phone and Password, and you are fully responsible for all activities that occur under your account. You agree to immediately notify Liberty Carz of any unauthorized use of your account or any other breach of security and to ensure that you exit from your account at the end of each session. Liberty Carz cannot and will not be liable for any loss or damage arising from your failure to comply with this section.
FEES, PAYMENT AND DELIVERIES
It is the sole responsibility of the Buyer to verify fees charged by Liberty Carz prior to incurring such charges. All fees and charges are subject to change without notice. Full payment for cars must be made on or before the invoice due date. Car not paid for within the above-specified timeframe will be repossessed and released to other interested parties and your deposit, which the Buyer might have paid upon registration, will be paid to Liberty Carz and kept in full. In addition, you will be liable for any loss caused by repossession and sale to another party and your account might be deactivated.
BUYING POLICIES
The Buyer and the respective seller (hereinafter known as “Seller”, which could be any other seller using Liberty Carz’s platform, depending on the individual type of transaction chosen from time to time) shall collectively be known herein as the “Sales Parties”, WHEREAS, Seller desires to sell the car as described on Liberty’s app, known herein as the “Acquired car”, under the terms and conditions set forth in this Term & Condition document; WHEREAS, Buyer desires to purchase the Acquired car offered for sale by Seller under the terms and conditions set forth in this Term & Condition document; and, therefore, IN CONSIDERATION of the mutual promises and other valuable consideration exchange by the Sale Parties as set forth herein, the Sale Parties, indenting to be legally bound, hereby agree to the Price displayed and confirm on Liberty Carz app and any additional services acquired. The Total Purchase Price payment can be made by the Buyer to Liberty by bank transfer or an accepted type of credit card (Buyer pays all due transaction fees).
The bank transfer details will be confirmed via email to the Buyer’s registered email address.
PRIVACY POLICY
Registration Data and certain other information about you are subject to our Privacy Policy.
MINORS
Minors under the age of 18 are prohibited to register as a User of this app and are not allowed to transact or use the app.
LIBERTY CARZ CONTENT
You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages or other materials (“Content”), whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such Content originated. You understand that by using the Service, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will Liberty Carz be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available through the Service. Any opinions, advice, statements, services, offers, or other information or content expressed or made available by third parties, including information providers, users are those of the respective author(s) or distributor(s) and not of Liberty Carz. You acknowledge and understand that you are solely responsible for the retrieval and use of the Content, transactions, products or services available on or through the Service. You should apply your own judgment in making use of the Content, including, without limitation, the use of the Content as the basis for any conclusions or for the sale or purchase of any cars or services or other transactions.
GENERAL PRACTICES REGARDING USE AND STORAGE
You acknowledge that Liberty Carz may establish general practices and limits concerning use of the Services, including, without limitation, the maximum number of days that messages, profiles or other uploaded Content will be retained by the Service, the maximum number of messages that may be sent from or received by an account on the Service, the maximum size of any message that may be sent from or received by an account on the Service, the maximum disk space that will be allotted on Liberty Carz’s servers on your behalf, and the maximum number of times (and the maximum duration for which) you may access the Service in a given period of time. You agree that Liberty Carz has no responsibility or liability for the deletion or failure to store any messages and other communications or other Content maintained or transmitted by the Service. You acknowledge that Liberty Carz reserves the right to log off accounts that are inactive for an extended period of time. You further acknowledge that Liberty Carz reserves the right to change these general practices and limits at any time, in its sole discretion, with or without notice.
MODIFICATIONS TO SERVICE
Liberty Carz reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that Liberty Carz shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.
TERMINATION OF ACCESS
You agree that Liberty Carz, in its sole discretion, may terminate your account (or any part thereof) or use of the Service, and remove and discard any Content within the Service, for any reason, including, without limitation, for lack of use or if Liberty Carz believes that you have violated or acted inconsistently with the letter or spirit of the Terms & Conditions. Liberty Carz may also in its sole discretion and at any time discontinue providing the Service, or any part thereof, with or without notice. You agree that any termination of your access to the Service under any provision of this Terms & Conditions may be effected without prior notice, and acknowledge and agree that Liberty Carz may immediately deactivate or delete your account and all related information and files in your account and/or bar any further access to such files or the Service. Further, you agree that Liberty Carz shall not be liable to you or any third-party for any termination of your access to the Service.
NO RESALE OF SERVICE
You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, any portion of the Service, use of the Service, or access to the Service. Additionally, you agree not to engage in any type of data scraping, copying including mass copying, or spidering with regards to this app.
LIBERTY CARZ’s PROPRIETARY RIGHTS
You acknowledge and agree that the Service and any necessary software used in connection with the Services (‘Software’) contain proprietary and confidential information that is protected by applicable intellectual property and other laws. You further acknowledge and agree that Content contained in sponsor advertisements or information presented to you through the Service or advertisers is protected by copyrights, trademarks, service marks, patents or other proprietary rights and laws. Except as expressly authorized by Liberty Carz or advertisers, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Service or the Software, in whole or in part. Liberty Carz grants you a personal, non- transferable and non-exclusive right and license to use the object code of its Software on a single computer, provided that you do not (and do not allow any third party to) copy, modify, create a derivative work of, reverse engineer, reverse assemble or otherwise attempt to discover any source code, sell, assign, sublicense, grant a security interest in or otherwise transfer any right in the Software. You agree not to modify the Software in any manner or form, or to use modified versions of the Software, including, without limitation, for the purpose of obtaining unauthorized access to the Service. You agree not to access the Service by any means other than through the interface that is provided by Liberty Carz for use in accessing the Service.
TRADE-MARK INFORMATION
Liberty Carz brand, the Liberty Carz logo are trademarks of Liberty Technology. All other company names, brand names and logos used on Liberty Carz are the trademarks of their respective owners. You agree not to display or use in any manner any of the trademarks without express written permission from Liberty Carz or the trademark owner.
COPYRIGHT INFORMATION
The Content on Liberty Carz is protected by various copyright laws. You agree not to reproduce, republish or redistribute any Content, including, but not limited to, caching, framing and similar means, without express written permission of the copyright owner. If you believe that your work has been copied in a way that constitutes copyright infringement, or your intellectual property rights have been otherwise violated, please notify us immediately.
INTERNATIONAL USE
Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable Content. Specifically, you agree to comply with all applicable laws regarding the transmission of technical data exported from the country in which you reside.
CONFIDENTIALITY
You undertake to treat and maintain all Confidential Information, as strictly confidential and shall not be divulged to anyone except with the prior written consent of Liberty Carz, and only after such person has signed a confidentiality contract which terms are not less restrictive than the terms of this clause. Confidential information means any information or material or code possessed by or relating to Liberty Carz party, in whatever form including, without limitation written, oral, visual or electronic form, or on tape or disk (whether or not owned or developed by any Liberty Carz Related Party) of which the registered member may obtain knowledge, directly or indirectly, through or as a result of Liberty Carz’s app usage, access to any Liberty Carz Related Party’s premises or through discussions and communications with any Liberty Carz Related Party’s directors, employees, officers, agents, representatives, consultants or professional advisers, including, without limitation the terms and conditions of this agreement. The registered member shall not either directly or indirectly, transmit to or discuss with other persons or parties, including but not limited to relatives and
friends, any Confidential Information, especially login credentials to Liberty Carz’s website and services.
The restrictions under this clause shall remain in force even though:
– The confidential information has become known to third parties and /or to the general public.
– The confidential information has been furnished or made
known to the registered member by any person other than Liberty Carz.
– The Confidential information was in the possession of the registered member prior to its disclosure by Liberty Carz.
If the registered member commits a breach of any of his/her duties or obligations under this clause, he/she shall be fully liable to Liberty Carz for all losses and damages incurred or may be incurred as a result of such breach including but not limited to compensatory damage, lost profit, lost opportunity, attorney fees, and court fees as well as liquidated damages.
GENERAL INFORMATION
The Terms & Conditions constitutes the entire agreement between you and Liberty Carz and govern your use of the Service, superseding any prior agreements between you and Liberty Carz. You also may be subject to additional terms and conditions that may apply when you use affiliate services, third-party content or third- party software. The Service and the Content are not to be construed as any form of recommendation, promotion, endorsement, or an offer to sell any product or service, by or to enter any transaction with Liberty Carz.
